Terms of Service

These Terms of Service ("Terms") govern your access to and use of Whama ("Whama," the "Service") provided by Appkasa LLC ("we," "us," or "our"). By creating an account or using Whama, you agree to these Terms and our Privacy Policy.
1. The Service
Whama is an AI-powered business assistant that connects to your WhatsApp account (via QR pairing, similar to WhatsApp Web) to help you extract tasks, track relationships, search conversations, receive briefings, and get suggested follow-ups. Features may change over time; we may add, modify, or discontinue functionality with reasonable notice where practical.
Whama is not affiliated with, endorsed by, or sponsored by WhatsApp Inc. or Meta Platforms, Inc.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You must have the right to link the WhatsApp account you connect and to process the conversations you authorize Whama to analyze.
3. Account responsibilities
You agree to:
- Provide accurate registration information and keep it current
- Maintain the confidentiality of your credentials and API keys
- Notify us promptly of unauthorized access
- Use Whama only for lawful business or personal purposes
You are responsible for all activity under your account, including actions taken through connected devices and developer applications you create.
4. Acceptable use
You must not:
- Violate WhatsApp's terms, spam policies, or applicable messaging laws
- Use Whama to send unsolicited bulk messages or automate outbound WhatsApp messaging without proper consent
- Upload malware, probe or disrupt our systems, or circumvent usage limits or authentication
- Access another person's account or data without authorization
- Reverse engineer the Service except where permitted by law
- Use the Service to build a competing product by systematically scraping or replicating our models or UX
We may suspend or terminate accounts that violate these rules or pose security or legal risk.
5. WhatsApp connection
Linking WhatsApp is optional but required for core features. You understand that:
- Whama reads message content and metadata from chats you connect, subject to import limits described in our product documentation and FAQ
- Whama does not send WhatsApp messages on your behalf in the current product version; suggestions are for your review only
- You may disconnect at any time; we will stop processing new messages from that session
- WhatsApp may change its protocols or restrict access, which can affect Whama availability beyond our control
6. AI-generated content
Whama uses artificial intelligence to analyze conversations and produce tasks, summaries, scores, and recommendations. AI output may be inaccurate or incomplete. You should verify important decisions (pricing, commitments, legal matters, medical advice, etc.) independently. We disclaim liability for actions you take based solely on AI suggestions.
7. Subscriptions and payments
Some features require a paid subscription or usage-based credits. Prices and plan limits are shown at checkout or in-app. Payments are processed by Stripe; your purchase is also subject to Stripe's terms.
- Billing: Subscriptions renew automatically until canceled. You authorize us and Stripe to charge your payment method on each billing cycle.
- Trials: Free trials may convert to paid plans unless canceled before the trial ends. Trial eligibility and duration are shown at signup.
- Cancellation: You may cancel via the billing portal or account settings. Cancellation stops future charges; access may continue until the end of the current paid period unless otherwise stated.
- Refunds: Except where required by law, fees are non-refundable once a billing period has started. Contact us if you believe you were charged in error.
- Changes: We may change prices or plan limits with advance notice; changes apply on your next renewal after notice.
8. Developer API
If you use Whama's developer platform, you additionally agree to our API documentation, rate limits, and key confidentiality requirements. You must obtain end-user consent for data you access through OAuth scopes and maintain your own privacy policy and terms URLs where required. We may revoke API access for abuse or security concerns.
9. Intellectual property
We own the Service, software, branding, and documentation. You retain ownership of your content. You grant us a limited license to host, process, and analyze your content solely to operate and improve Whama as described in the Privacy Policy.
10. Confidentiality and security
We implement reasonable safeguards for your data as described in our Privacy Policy. You are responsible for securing devices where you are logged in and for complying with data-protection laws applicable to your business use of Whama (e.g. when storing customer conversations).
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT WHAMA WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Appkasa LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF WHAMA.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED US DOLLARS (USD 100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
13. Indemnity
You will defend and indemnify us against claims arising from your misuse of the Service, violation of these Terms, infringement of third-party rights, or unlawful messaging practices connected to your account.
14. Termination
You may stop using Whama and delete your account at any time. We may suspend or terminate access for breach, non-payment, or to protect the Service. Upon termination, your right to use Whama ends; provisions that by nature should survive (payment obligations incurred, disclaimers, liability limits, governing law) will survive.
15. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles. You agree that disputes will be subject to the exclusive jurisdiction of the courts of Sharjah, United Arab Emirates, unless mandatory consumer protection laws in your country require otherwise.

16. Changes
We may update these Terms. The revised version will be posted on this page with an updated date. Continued use after changes become effective constitutes acceptance. If you do not agree, you must stop using the Service.
